2004 PASQUOTANK RIVER YACHT CLUB MARINA RULES

 

FAILURE TO COMPLY WITH ANY RULES:  The Rear-Commodore is empowered and required by the bylaws to chain vessels and recover any fees due via liens legally applied.  The slip holders are required to enforce all other rules.

 

THIS AGREEMENT IS AN ATTACHMENT TO THE DOCKAGE AGREEMENT OF THE PASQUOTANK RIVER YACHT CLUB, INC.

 

Facilities:

The marina has thirty (32) slips available for yacht club members.   Transient reciprocal dockage is available. 

The dock area is lighted.  A pump out station is available.   Shore power and potable water are provided with restrictions.

 

Agreements: 

The Agreement period is for one calendar year, all Agreements terminate in  December.  Agreements can be applied for by any active club member by submitting a slip application to the Rear-Commodore.   Applications are subject to a 90 day waiting list.   The Board will vote to approve or disapprove the application pending slip availability and members club activity.  Slip renewals are not guaranteed.  Prior to the end of the calendar year the Board will review all slip Agreements.  Timely slip rental payments and club activity will be taken into consideration.   Late payments are subject to Agreement termination at the Board’s discretion.  Slip Agreements can be terminated at any time during the year by vote of the board.  The Rear Commodore assigns slip spaces. 

  

Rates:

Slip rental payments can be made either by the month or by the year.  Monthly slip rates are $1.75 per foot due before the first day of each month.   If the slip rent is paid by the year  the Lessee will only be charged for eleven months, the twelfth month is free.   Yearly rent is due in January.  Payments received after 31 January are not entitled to the twelfth month free.   In addition to slip rent there will be additional charges for electricity and possible  fines.   Electrical use charges are by a flat rate of $10 per month, by agreement based on registered non-metered usage,  or by meter where available. 

 

Lease  Termination: Upon termination of a lease the vessel owner will be required to remove his or her vessel within thirty days.   If vessel remains past the lease termination date the slip rental rate becomes $1.75 per foot per day plus any legal fees.

 

Fines:  Each slip holder is required to attend one of the two work parties (spring or fall).   In lieu of  attending a work party a $150.00 assessment will be charged.

 

Gate Key:  A charge of $2.00 per gate key issued is due at the time that a key is given to a slip holder.  Gate keys must be returned to the Rear-Commodore at the time a slip is vacated.  Upon failure to return the key, Lessee is solely responsible for assuming costs to the yacht club of changing the gate lock and reissuing of all outstanding keys.

 

All fees assessed for dock usage are payable upon receipt of the invoice and are due on or before the end of each month.  Late payments are subject to lease termination at the Board’s discretion.

 

Dock fees entitle the slip holder to moor only the vessel registered in his or her name as described in the Agreement.  Sub-leases may be permitted to active club members only upon making application to the board for approval.

 

Rules:

1.             All members who have a boat at the yacht club docks are required to participate in work parties.  There will be a minimum of two scheduled, one in the spring and one in the fall.  If a work party has not been attended by the close of the second work party, the fee will be assessed. Failure to pay the assessment within 30 days of invoice will result in termination of the Agreement and eviction from the facilities.  The boat must be removed from the facilities by the first of the subsequent month.

 

2.             Slip holders are charged with the duty of maintaining activity with in the club by volunteering services and time to further the club’s boating and social activities. 

 

3.             General maintenance of the dock, water service, electric power service and lighting is provided by the yacht club.  If electrical service is used, it will result in a charge for such use.  Any of these services may be interrupted at the discretion of the yacht club for reasons involving any fees due the club, safety, repair, or protecting any of the equipment from potential damage.  ELECTRICAL POWER CHARGES:  A minimum charge of $10.00 or their metered usage at current club costs per kilowatt, whichever is greater.  For non metered slips this covers not more than two 60 watt lamps in use.  Non metered slips requiring more electrical use must register their usage with the Rear-Commodore and such usage will be reviewed by the Board of Directors.  Such electrical power use may not begin until the Board of Directors has approved such use and a fee for the service has been agreed upon.  Such electric use may include heaters, refrigerators, cooking equipment etc.  Electric fees will be billed at the clubs convenience.

 

4.             To facilitate use of the water service and cleaning of the property, hoses and spray nozzles are provided at each spigot by the club.  After use, all hoses are required to be stored neatly on its rack on the face of the piling.  When not in use, remove the spray nozzle and place it on the spindle provided.  This prevents pressure build up in the lines, which will damage the equipment.

 

5.             LIGHTING:  There are two street light style lamps on the docks which have switches on their respective poles.  Please turn these lights off when not in use.  There is also dock level lighting provided by a series of timed lamps.  It is the slip holders’ responsibility to notify the Rear-Commodore of lights that fail to function properly.

6.             Dock lines shall be attached to cleats with minimum length tails to eliminate tripping hazard and improve appearance.   Where cleats are provided on the docks, the cleats shall be used rather than pilings for securing lines.  Dock lines shall be maintained in adequate condition, numbers and size based on vessel moored.  Failure to maintain proper lines may result eviction.

 

7.             Shore power cords of excess length should have extra footage neatly coiled and stored on board the boats, rather than on docks or pilings.  Most slips have been provided a hose rack to store the cords neatly near the outlets.  Shore power cords should not dip into the water.

 

8.             Dock boxes or other material to be stored on the dock must have prior approval of the Board of Directors or the Rear-Commodore.  Approval may be revoked by the Board of Directors at any time.

 

9.             The yacht club maintains a self service WASTE PUMP OUT ON THE DOCKS.  There should be no waste discharge of effluent into the marina proper.  Such waste is to be handled in accordance with current US Coast Guard and North Carolina state regulations.  A pump-out system is available for the emptying of holding tanks.  Notify the Rear-Commodore of any problems involving the use of this system.

 

10.          NO TRASH DISPOSAL SERVICE IS PROVIDED!  Remove all trash to your residence to help maintain a clean and litter free environment. 

 

11.          SECURITY:  The gate should be locked whenever the marina is vacated, as well as the toilet facilities and phone/electrical building at the head of the docks.  As soon as the last member leaves the dock the gate must be locked.  It is the slip holder who is responsible for the general security of the docks and vessels.  Suspicious persons, vessels, or vehicles should be reported to the Rear-Commodore, members of the Board of Directors, or local law enforcement authorities.  Record all pertinent information regarding boat style, color, registration numbers, and description of any suspicious persons, or color, description and registrations information regarding automobiles. 

 

12.          REPAIR POLICIES:  The marina repair policy is as follows:  Members occupying permanent slips, reciprocal yacht club members as PRYC members’ guests may have commercial repairs done at the docks.  No commercial agent, member or non member, may enter the dock facility for the purposes of performing or investigating a repair job without first submitting a copy of their insurance certificates to the Rear-Commodore.  No non-member boat shall be brought into the PRYC docks for the purpose of repairs, renovations, or commercial operations.

 

13.          TRANSIENT SLIP USE:  Transient vessels and their operators or owners are subject to all marina rules. 

 

                Transient boats will be assigned slips by the Rear-Commodore in advance or upon arrival.  The Rear-Commodore is allowed to approve the transient vessel’s stay if the following is provided:  identification of a visiting yacht club and/or notification from a PRYC member.  PRYC/Rear-Commodore retains the right to reassign any transient vessel to a different slip and to terminate any stay at any time.

 

                The yacht club marina policy governing the transient slips is as follows:  Transient boats may stay in the designated transient slips 72 hours without Board approval.  If the stay exceeds 72 hours, approval from a minimum of three (3) Board members must be obtained and a fee of $1.75 per foot will be assessed daily at the Board of Director’s discretion.

LESSEE CERTIFIES THAT THE MARINA RULES HAVE BEEN READ AND THE TERMS AND CONDITIONS AND ALL OTHER MATTERS SET FORTH ARE FULLY UNDERSTOOD, ARE ACCEPTABLE, AND ARE HEREWITH AGREED TO BY LESSEE AS AN ATTACHMENT TO THE DOCKAGE AGREEMENT.
